
Minister De Silva participating in the committee stage debate on budget 2015 under the expenditure heads of the Ministry of Irrigation and Water Management said that the Supreme Court had conveyed to the President that by virtue of powers vested on the President by the provisions
Minister de Silva revealed that the judgment had also said that there was no legal impediment to the President opting for a snap presidential election.
"The Supreme Court has delivered an excellent judgment," the minister said.
The Supreme Court on Monday conveyed to President Mahinda Rajapaksa its determination on his reference asking whether he could seek re-election for third term.
In terms of Article 129 (1) of the Constitution, Rajapaksa referred the following questions for determination last Thursday.
(A) Whether in terms of Article 31 (3A) (a)(i) of the Constitution, as amended by the 18th Amendment, I, as the incumbent President, serving my second term of office would have any impediment after the expiration of four years from the date of commencement of my second term of office on November 19, 2010, to declare by Proclamation my intention of appealing to the people for a mandate to hold office as President by election for a further term.
(B) Whether in terms of the provisions of the Constitution as amended by the 18th Amendment, I as the incumbent President, serving my second term of office was functioning as such on the date the 18th Amendment was enacted would have any impediment to being elected for a further term of office."
